  • Accurate Information: You agree to provide accurate and complete information when creating an account or participating in a contest.

  • Site Availability: squarescontest.com does not guarantee that the Site will be available at all times. We are not liable for any losses or damages arising from the unavailability of the Site.
  • Third-Party Content: The Site may contain links to third-party websites or content. We are not responsible for the content, privacy policies, or practices of any third-party websites.

All content, trademarks, and other intellectual property on the Site are owned by squarescontest.com or its licensors. You may not use any content from the Site without our prior written permission.

6. Termination of Use

We reserve the right to terminate or suspend your access to the Site at our sole discretion, without notice, if you violate these Terms of Use or engage in any conduct that we deem harmful to the Site or other users.

7. Limitation of Liability

To the fullest extent permitted by law, squarescontest.com and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Site; (b) any unauthorized access to or use of our servers and/or any personal information stored therein.

These Terms of Use are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions.

9. User-Generated Content

  • Content Ownership: Users retain ownership of the content they create on the Site, such as contest setups and entries, but grant squarescontest.com a non-exclusive, royalty-free, worldwide license to use, distribute, and display that content in connection with the operation of the Site.
  • Prohibited Content: Users agree not to post content that is unlawful, defamatory, obscene, harassing, or otherwise offensive. squarescontest.com reserves the right to remove any content that violates these terms.

10. Contest Rules and Responsibilities

  • Contest Fairness: Users who create or participate in contests must adhere to the rules of fair play. Manipulation, cheating, or other forms of dishonest conduct are strictly prohibited.
  • Prizes and Rewards: squarescontest.com is not responsible for the administration or fulfillment of any prizes or rewards associated with contests created on the Site. The responsibility lies solely with the contest creator.

11. Payment and Fees

  • Fee Structure: Creating a premium white-labeled squares contest on squarescontest.com requires a one-time fee of $250 per contest. Payment must be made in full at the time of creating the contest.
  • All Sales Final: All sales are final and non-refundable. However, if you experience a catastrophic issue that prevents you from creating or managing your contest (e.g., prolonged site outage or severe technical error), you may request a refund by emailing [email protected]. squarescontest.com will evaluate refund requests on a case-by-case basis and determine, in its sole discretion, whether an issue qualifies as catastrophic.
  • Minor Outages and Site Availability: As a newly launched service, minor outages or intermittent downtime may occur. These do not constitute grounds for a refund unless they rise to the level of a catastrophic issue as described above.
  • Third-Party Payment Processors: Payment processing may be handled by third-party payment processors. By paying any fees on the Site, you agree to comply with the terms and conditions of the applicable payment processor.

12. Indemnification

  • Users agree to indemnify and hold harmless squarescontest.com, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising from their use of the Site, violation of these Terms of Use, or infringement of any third-party rights.

13. Modification of Terms

  • Changes to Terms: squarescontest.com reserves the right to modify these Terms of Use at any time. Users will be notified of significant changes, and continued use of the Site constitutes acceptance of the updated terms.

14. Account Termination and Suspension

  • User Account Termination: Users may terminate their accounts at any time by following the account termination procedures on the Site. squarescontest.com also reserves the right to terminate or suspend user accounts for any reason, including breach of these Terms of Use.

15. Dispute Resolution

  • Arbitration: Consider including an arbitration clause requiring disputes to be resolved through binding arbitration rather than through the courts. This can limit the potential for costly litigation.
  • Governing Law: These Terms of Use are governed by the laws of the State of Florida, and any legal proceedings must be brought in the appropriate courts located in Florida.

16. Limitation of Use

  • Age Restriction: You must be at least 18 years old to create an account or participate in contests on the Site. If you are under 18, you may only use the Site under the direct supervision of a parent or guardian who agrees to be bound by these Terms of Use.
  • Geographic Restriction: The Site may not be available or intended for use in all jurisdictions. It is your responsibility to ensure that accessing or using the Site complies with the laws of your jurisdiction.
  • Service Interruptions: By using squarescontest.com, you acknowledge that the Site is a newly launched service. Minor outages or service interruptions may occur as we continue to improve and optimize our platform. Such minor outages do not constitute grounds for refunds unless they escalate to a catastrophic issue as defined in Section 11.

17. Data Protection and Privacy

18. Waiver and Severability
